Canadian courts delivered several notable decisions last year that affected Canadian business. Not all were pro-business; for example, its decision in R. v. Comeau essentially ruled in favour of interprovincial trade barriers. But the Supreme Court of Canada’s nod in favour of the constitutionality of the federal securities regulation scheme finally provided some teeth to the prospects of a unified securities regime.
As well, a decision of the Ontario Divisional Court assured contractors subjected to municipal disbarment that due process was an integral part of the regime, while Re Aurora Cannabis Inc. fulfilled the promise of the new hostile takeover rules by dimming the light on tactical rights plans and the expensive litigation that accompanied them.
